Probate is the first step in the legal process of administering the estate of a deceased person whereby all claims are resolved so that distribution of the deceased’s property under will or not can occur. It is the legal process required to be completed when someone dies leaving behind property or assets.
In such cases an application needs to be filed to the court to open a probate case. If there is a Will this is done by the person named as executor otherwise the family of the deceased can petition the court. Since administration of the estate can be complicated a lawyer usually assists the executor or administrator. This is a process which involves finding and listing all the deceased’s assets and liabilities and then distributing or liquidating them in accordance to the law of the deceased’s domicile and, if available, according to the deceased’s wish.
Our firm has had a wide experience in handling a number of administration of estates. We may assist with the administration of the estate as well as with any other issue which may arise in the process offering fast and effective solutions ensuring compliance with the law and swift conclusion of the usually emotionally draining process.
